Laws Proposed to Modernize Vaccine Injury Compensation Program (VICP) May Include COVID-19 Shots

A bipartisan group of United States Representatives introduced a bill in Congress to modernize the current Vaccine Injury Compensation Program (VICP). The key elements of the bill would:

  1. Speed up the time it takes to add new vaccines to the VICP.
  2. Increase the statute of limitation to file a claim from 3 years to 5 years.
  3. Add more judges to the program so claims are processed faster.
  4. Increases the amount of damages that can be awarded 
  5. Expands the types of vaccines that can be covered by the VICP to include adult vaccines in addition to childhood vaccinations.

Adding COVID-19 vaccines to the VICP is in the best interests of everyone. There is no opposition or ongoing political or public argument against this addition. There is only inaction. 

What Can I Do to Get COVID Vaccines into the VICP?

1. Contact your Congressperson and your Senators

Tell them to support Bill H.R. 5142 and Bill H.R. 5143 to streamline the addition of new vaccines like COVID to the VICP.

2. File a VAERS Report

File a patient report in the Vaccine Adverse Event Reporting System (VAERS) and save a copy of it.

3. Sign the Change.org Petition

Sign the Change.org petition asking the Secretary of Health and Human Services (HHS) to add COVID-19 vaccines to the Vaccine Injury Compensation Program.

Will Covid-19 Vaccines ever be covered under the VICP? 

At some point in the future, yes. In order for that to happen, three things must occur: 

  1. The vaccine must be recommended for routine administration to children
  2. Congress must impose an excise tax on each dose of the vaccine
  3. Covid-19 vaccine must be added to the VICP vaccine injury table

Should I file in the CICP or wait to file in the VICP? 

There’s a strict one-year time limit to file in the CICP. We do not know if and when the Covid-19 vaccine may be added to the VICP. If you wait for that, you could potentially miss your opportunity to file in the CICP.
