Attorneys made their closing arguments today in the DePuy Pinnacle Metal on Metal hip replacement trial.  Now the case is in the hands of the jury, which also began deliberations today, March 10, 2016.

Proceedings began weeks ago and jurors spent a total of 37 days in court listening to testimony and reviewing evidence.   Jury selection took place on January 8, 2016. Nine jurors were chosen and seated for the trial, according to the electronic minutes listed on the US District Court, Northern District of Texas website for MDL 3:11-md-02244.

After opening statements defense attorneys for DePuy moved for a mistrial, saying the plaintiffs tried to “prejudice the jury against defendants by introducing irrelevant, highly inflammatory evidence that has no place in a product liability trial,” according to Harris Martin Publishing.   Federal Judge Ed Kinkeade denied the motion for mistrial and rejected the claim that the statements were “highly inflammatory.”

The first witness called by the Plaintiffs in January was Andrew Ekdahl, former CEO of DePuy Orthopaedics. Also on the witness stand, Pam Plouhar, head of Clinical Research at DePuy, Dr. Antoni Nargol testified by video deposition, and a number of other surgeons and orthopaedic experts took the stand.

The attorneys at Maglio Christopher & Toale, P.A. are keeping track of the trial and will let you know once the jury comes back with a verdict. “Our firm filed the very FIRST metal on metal hip replacement lawsuit in the United States back in 2008,” says Altom M. Maglio, Managing Partner. “We have been a leading law firm fighting for hip replacement clients since the beginning of this era of defective MoM devices, and will continue to be on the front lines of this fight.”

We all will die from these defective hips before we see a penny. Johnson and Johnson has the politicians in their back pocket along with the judges over seeing these cases. Why do you think nothing was said about the 502 million verdict against them? They want us all to die so they do not have to pay. They should make everyone on the board, shareholders, and company executives be implanted with the pinnacle and let them see how it feels to have their lives ruined since they think that their is nothing wrong with these metal on metal hips. This is a night mare that has no ending till we all die.
