DePuy ASR Hip Settlement Extended Through January 2015

Johnson & Johnson has agreed to extend their settlement agreement over their recalled DePuy ASR hip implants, according to reports by Bloomberg News.  The new agreement would pay up to $420 million more to patients excluded from the original 2013 settlement.

New Deadline of January 31, 2015

The new deadline to file a claim is January 31st of this year.  Originally DePuy set a cutoff date of August 31, 2013 to have revision surgery in order to get about $300,000 in compensation.  That left out anyone who had a defective ASR hip replaced in the last 18 months.  According to Bloomberg News, the extension will bring up to 1,400 new patients into the settlement program.  That means about 90% of all current lawsuits will be resolved with this new claims date.

Missed Both Deadlines? Or Haven’t Been Revised Yet?

So what happens if you have NOT had surgery to remove the defective ASR yet?  The new extension still leaves out thousands of people who currently have a defective ASR hip in their bodies.
